These Terms of Service ("Terms") govern your use of the GoListen mobile application ("GoListen", "the App"), operated by Peak Pixel Web ("we", "our", or "us").
By downloading, installing or using GoListen, you agree to these Terms. If you do not agree with them, you must not use the App.
1. About GoListen
GoListen provides access to location-based and audio-guided tours together with optional Premium Membership features.
We may add, modify, improve or remove features from time to time without prior notice.
2. Eligibility
You must comply with all applicable laws when using the App.
If you are under the legal age required to enter into contracts in your country, you should only use GoListen with the permission of a parent or guardian.
3. Accounts
Certain features require you to sign in using your Google Account.
You are responsible for:
- Keeping your account secure.
- Providing accurate account information.
- All activity carried out using your account.
You should notify us immediately if you believe your account has been compromised.
4. Premium Membership
GoListen offers optional Premium Membership subscriptions.
Subscriptions are purchased through:
- Apple App Store
- Google Play Store
Payments, renewals, refunds and cancellations are managed by Apple or Google in accordance with their own policies.
Except where required by law, Peak Pixel Web cannot issue refunds for purchases made through Apple or Google.
5. Licence
We grant you a limited, non-exclusive, non-transferable and revocable licence to use GoListen for your own personal, non-commercial use.
You must not:
- Copy or reproduce the App.
- Modify or create derivative works.
- Reverse engineer or decompile the App except where permitted by law.
- Resell, lease or sublicense the App.
- Remove copyright or proprietary notices.
6. Intellectual Property
All intellectual property rights relating to GoListen remain the property of Peak Pixel Web or our licensors.
This includes, but is not limited to:
- Software
- Audio content
- Tour content
- Graphics
- Maps
- Logos
- Text
- Branding
- Trademarks
Nothing in these Terms transfers ownership of our intellectual property.
7. User Conduct
You agree that you will not:
- Use GoListen for unlawful purposes.
- Attempt to gain unauthorised access to our systems.
- Upload malware or malicious code.
- Copy or scrape tour content.
- Interfere with the operation of the App.
- Use automated software to access the App.
- Circumvent Premium Membership restrictions.
We reserve the right to suspend or terminate accounts that breach these Terms.
8. User Content
Where GoListen allows users to submit reviews, comments, photographs or other material, you retain ownership of your content.
By submitting content, you grant Peak Pixel Web a worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish and display that content for operating and promoting GoListen.
You confirm that you own or have permission to submit any content you upload.
9. Availability
Although we aim to keep GoListen available at all times, we cannot guarantee uninterrupted access.
The App may be unavailable due to:
- Maintenance
- Software updates
- Technical faults
- Internet outages
- Events beyond our reasonable control
10. Location Accuracy
Some features rely on GPS or other location technologies.
Location accuracy depends upon your device, satellite reception, weather conditions and surrounding environment.
We cannot guarantee that location information will always be accurate.
11. Safety
You remain responsible for your own safety while using GoListen.
You should always:
- Remain aware of your surroundings.
- Follow local laws and regulations.
- Obey traffic signs and signals.
- Avoid using the App where it may distract you from hazards.
GoListen must never be relied upon for emergency navigation or safety-critical decisions.
12. Third-Party Services
GoListen integrates with third-party services including:
- Google Sign-In
- Google Play Store
- Apple App Store
We are not responsible for the availability, security or content of third-party services.
13. Privacy
Your use of GoListen is also governed by our Privacy Policy, which explains how we collect and process personal information.
14. Suspension and Termination
We may suspend or terminate your account if:
- You breach these Terms.
- Your activities pose a security risk.
- We reasonably suspect fraudulent activity.
- We are required to do so by law.
You may stop using the App at any time by uninstalling it.
15. Disclaimer
GoListen is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we make no warranties regarding:
- Availability
- Reliability
- Accuracy
- Fitness for a particular purpose
- Error-free operation
Nothing in these Terms excludes statutory consumer rights that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, Peak Pixel Web shall not be liable for:
- Indirect losses.
- Consequential losses.
- Loss of profits.
- Loss of business.
- Loss of data.
- Loss arising from third-party services.
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot legally be excluded.
17. Changes to the App
We may update, improve, remove or discontinue features or services at any time.
18. Changes to these Terms
We may amend these Terms from time to time.
The latest version will always be available within the App or on our website. Continued use of GoListen after changes become effective constitutes acceptance of the updated Terms.
19. Governing Law
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence apply.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless applicable law provides otherwise.
